THE EXECUTION OF SERGEANT STEVENS DECEMBER ARREST

The Arrest

On the morning of December 14, 2022, I heard an enormous bang. Looking out of my fifth-floor office window, I saw multiple vehicles, including what looked like two large police personnel carriers. In one of the most surreal moments of the yearlong campaign, I slipped into what I describe as dual reality. Knowing what was happening, one part of me sat down at my desk, lit a cigarette, and waited for the inevitable. The other part, in denial, messaged the housekeeper to ask what the bang was, hoping for an explanation other than what was unfolding.

 

Masked and armed SWAT team officers came from either end of the office or bedroom. One came up the spiral staircase and one up the lift. The others went through the property, blowing door after door despite all being unlocked. I was told to get face down on the floor, hands tied.

 

The special task force asked where the guns were, and I responded that there were no guns. “I have a self-defence mace spray gun in my handbag,” I said, gesturing to the orange handbag by my desk.

The SWAT team seemed both confused and disappointed, as if expecting Pablo Escobar and a stash of submachine guns, instead finding a glorified water pistol in an interior designer’s handbag.

 

Several plain-clothed and uniformed officers joined shortly after the SWAT team confirmed they had secured their target.

 

They were then joined by Wouter de Swardt, who walked into my bedroom, pointing and laughing at me, and taking photos with his camera—like a tourist looking at an oddity at the circus.

 

I had actually asked the senior officers the same question three times. I watched the police, both plain-clothed and uniformed, tear through the property, opening every cupboard, every drawer, and looking in every nook and cranny. In my office, they had cleared out literally everything: the laptops, phones, hard drives, backup drives, and every document, piece of paper, folder, and file.

 

However, in all the other rooms, they did no such thing; they would open cupboards and drawers, and in those, there was paperwork, some clerically official-looking, and they simply moved on to the next drawer. So, they were clearly not looking for paperwork, documents, or letters. But it was clear they were looking for something specific.

 

So, I asked the Investigating Officer, “What are you guys looking for so intently and so specifically?” He was aggressive in his reply and said, “You’ve seen the warrant; you know why we’re here!”

 

When we were in the room and I saw the same behaviour, I asked again. Referring to the warrant he mentioned, I said, “You are here to arrest me for fraud, yet you are looking in every place and disregarding paperwork, files, and things that could have a bearing. You guys are clearly looking for something specific. What is it?”

 

An officer was passing by at the time, and he tore me to shreds. He was very aggressive and in my face, and I felt that his aggression was definitely excessive. They all seemed more and more frustrated and anxious as the search continued, and nothing was found.

 

It could have been guns they were looking for if Wouter de Swardt had told them there were guns to motivate the SWAT team. But guns are not large, and they were not looking after papers. Whatever it was, it was small enough to fit in a closet but too large to be under some paperwork.

 

They were looking for a suitcase of cash and diamonds. Or, at the very least, a suitcase with lots of cash in it. Wouter de Swardt has obviously never found a secret bank account. I know this because there has never been one. But if he thought I had been banking millions legally or illegally, it had to be somewhere. And my home made the most sense.

The agreement and explicit understanding was that I would lease the properties, entirely refurbish them at my own expense, then let them out to tourists, and significantly that I would have a legal tenure of 5 years during which time to recoup the very considerable investment of time. money and expertise,

 

That proposal cam e not from me but from Keith, Inge and Gail Broad. The continent of the Media24 articles, was the polar opposite of the truth and the facts

Serg Stevens Use And Abuse Of Police And State Resources For The Personal Gain Of Others

The obscene and intentional misuse of police, state resources and taxpayer money. The numbers and ranks, entirely unwarranted and unjustified and bearing no relevance to the charges themselves, or the docket.

 

The huge team and the huge operation, all under the command and control of Serg Stevens  had nothing to do with the charges and everything to do their actual agenda.

 

  • Find the safe with the diamonds and cash in it.

  • Maximum press coverage and maximum humiliation for the accused.

  • Maximum kudos for those in charge, providing numerous benefits. For Mr de Swardt’s the press coverage of him taking down a major crook, for Serg Stevens  likely a promotion.

ABUSE OF STATE POWER AND RESOURCES

The Astonishing, Unjustifiable and Illegal Use and Abuse of State Resources To Action An Illegal Seizure Warrant Supposedly Related To Three Cases Of Fraud From a Year Earlier

“Members Involved, and those not mentioned”

Nowhere on the list of those taking part in the search and seizure does it mention either Wouter de Swardt or Denis Dalton.

 

Yet they were allowed inside my home, allowed to search my home, allowed to lead the operation and allowed to carry out the secret, unofficial and illegal raid and arrest [illegal eviction] at the other Llandudno property.

The Suitcase of Black Diamonds & Cash

Combined, they tore my home apart. I noticed they were looking for something particular. When I inquired, I was firmly shut down. I noted that the police would go from drawer to drawer and room to room, leaving large swathes of paperwork and files untouched. If this were an arrest for fraud, all would have been taken. So, it was something else they were looking for. I suspected I knew.


My suspicions were confirmed when, to my shock, I came across Wouter de Swardt and DD in my bedroom as I was being taken from room to room to assist with the search.


(Or rather the Investigating Officer told me I needed to accompany them around the property through each room despite the housekeepers having already done that and the search winding down. The first room was taken to be the master bedroom, however, after I had been questioned by Wouter de Swardt and DD this supposed tour of the property ended and I was taken from the main house to the guest apartment. I later realised the reason for taking me to the bedroom was at the instruction of Wouter de Swardt so he could ask the location of the safe. There was no tour of the property intended).

Wouter de Swardt was clearly in charge of the operation. DD asked, “Where is the safe?” My response was, “What safe?” DD replied: “The big one behind the secret door.” I realised they meant the vault at the Camps Bay villa, which had been handed back some months earlier. “You are a few months too late. That is at the Hove Road property.” The disappointment was evident. By now, the search was nearing its end and had yielded nothing.


The fact that they had to ask me demonstrated that they had found nothing and were getting desperate.


They had no suitcase of black diamonds or cash to share.


It is also a clear sign of what they were really looking for clearly was not paperwork or items related to fraud.


I was deeply shocked that Wouter de Swardt and DD were walking around my home as if they owned it. With the police deferring to their ‘authority.’ Most shocking was that one of the men standing in my bedroom, clearly enjoying my humiliation, was the man that just a few weeks earlier had stolen over a million rand from me, set up a scam agency defrauding people by using my properties and planning to torture, murder and replace me.


The other was a criminal Private Investigator who had somehow engineered an opposition of authority and relationship with and over some very senior police officers that allowed him to assume the role usually reserved for a Brigadier or commander. When in fact he was a civilian with no official powers of any kind.

I overheard him saying that. Uh, some, some magistrate, uh, some magistrate is it in Hout Bay or somewhere else refused to give them a warrant of arrest, they had to go somewhere.  Yeah.

 

So, I knew that, uh, It's a, it's a, it's a, it's a, it's a battle that it'll be very tough for you maybe to win.

Wouter de Swardt and his inclusion in the arrest and raid.

 

The question has to be asked as to how a private individual with no official rank or position in SERGEANT STEVENS / SAPS get to lead a raid and arrest. Both at 32 FB and 16 LR. [SEE HOUSEKEEPER TESTIMONY] and other serious questions, including how Denis Dalton and Johan Schalkwyk became not just included in the raids and arrests, but central to them, walking around the home of the person the police are arresting not just with the knowledge of the investigating officer but with his direct assistance

 

14-19 Dec 22

Serg Stevens / SAPS, Wouter de Swardt; Corrupt manipulation by Serg Stevens  / SAPS and   Mr de Swardt of the media. INCLUDING THE STAGED EXIST.
 

After I had been taken to the bedroom, I was taken to the guest apartment where SERGEANT STEVENS had me fill out some paperwork. I wasn’t sure why he took me there but then I realised it was so they could get the journalists ready. As I was being taken downstairs, Denos Dalton called his partner Jihan Schalkwyk to warn him I was on my way and get the journalists ready. As I was being taken downstairs Mr de Swardt’s and Denis Dalton were following close behind.

 

Through the time the police were on site, I had seen both of them walking freely throughout my home and the three (SERGEANT STEVENS, Mr de Swardt’s, Denis Dalton) clearly very close and coordinating everything.

When I walked into the garage which was big enough to take the police car I saw Serg Stevens had parked it right out the front metres away from either the garage door or front door. Clearly to stage the exit. When the Hawks officer suggested Serg Stevens allow me to put a jacket over my face Serg Stevens refused.
 

As I was being taken to the car I realised that rather than going directly to the passenger door but instead Serg Stevens took me the long way round, all the way around the far side of the car to parade me to the journalists as Mr de Swardt’s had told him to.


Denis Daltons partner Johan Schalkwyk was also taken photos at the time and his photo appeared in the News24 article of 14 January 2023.

 

Schalkwyk & Dalton (sham private detectives with fake PSIRA license) included in the arrest.

 

The same applies to their inclusion, having no official rank and having only a few weeks earlier embezzled R1.2 million from DR and planned his drugging torture and murder to access and empty his bank accounts.

Up until we reached home. But one thing that surprised me in all this is I realized that, um, it was, um, the whole, the whole of this thing was a merger of two or three guys.  

 

I realized, I later on realized that it's the owner of the, it was between the owner of, uh, Fisherman's and Liermans.

Serg Stevens Choreographed Exit

Wouter de Swardt, looking on as his friend, colleague and co-conspirator Serg Stevens takes Mr. Russell to the waiting car. Which has been intentionally not parked in the huge quadruple garage but on the driveway, in full view of the media who had been told in advance of the arrest.

 

Not just parked on the driveway but bang centre for maximum vantage point and exposure. And then, as instructed sergeant Stevens takes Mr. Russell around the far side of the car. Again, for maximum exposure. Serg Stevens had called down to let Wouter de Swardt know he was on his way to ensure the waiting media were ready.

 

Only seconds earlier Serg Stevens handed Wouter de Swardt the keys to 16 Leirmans Road that his SAPS officers had conveniently raided at the same time, arrested the housekeepers, taken the keys from them and emptied the house of occupants.

 

A house and occupants that had nothing to do with the office and was not included anywhere on any paperwork related to the arrest r arrest warrant. No search was undertaken of the house. The sole purpose of the SAPS officers was to remove the occupants to give Wouter de Swardt vacant occupations and the keys.

 

In those few minutes Wouter de Swardt, Sergeant Stevens, Mr. & MRs Broad, Mr. Moonsamy, Rajeev Vasant Sheth and Krashani Deoshini Naidoo were able to void all legislation protecting tenants form illegal eviction, render PIE obsolete, place SAPS in control of and not subservient to the law, able to ignore and allow others to ignore rather than uphold it. It placed SAPS above parliament and the judiciary. It created a near bullet proof way to illegally evict a tenant legally. And do so cheaply with the South African taxpayer paying for it.

 

Making the months of civil litigation worthless, the huge cost wasted, and creating a very clear incentive to follow suit and illegally evict a tenant rather than follow the correct processes. Mr and Mrs Broad then moved quickly, having known of the arrest in advance and prepared the paperwork necessary, submitting it and hoping to have the matter pushed through while Mr Russell was unable attend or assist in any way.

EYE-WITNESS ACCOUNT LEIRMANS RD HOUSEKEEPER

I don't know how many there was in total. There was a lot. 'cause they were jumping over the walls. They were coming up the stairs. There was. 

But, um, yeah, 'cause I kept hearing explosions, and I wasn't, yeah. It was, there was a lot of explosions. 

Mm-hmm. Yeah. So that's my recollection. That's my, that's everything that I remember about the whole deal. Um, it was so traumatizing to me, you know, seeing the police, you know, I'm a law-abiding citizen.

Serg Steven’s Passing Of The Keys And Possession

There can be no justification or legal explanation whatsoever for Serg Stevens passing the keys to my home to Mr de Swardt. The property was my home, I was the only legal occupant, no court order existed giving him permission to do so. They should have eft my home after the arrest and had nothing whatsoever to do with anything related to the property.

 

This passing of the keys by Serg Stevens to Mr de Swardt, then Mr de Swardt to the owner (who walked in minutes after I was removed) very clearly demonstrates who Serg Stevens was working for and why.

Magistrates Rejection Of The Arrest Warrant

It was also discovered that they had requested an arrest warrant from one or more magistrates and had had that request declined.

 

They then took the identical docket to another magistrate to get approval. Although from looking at the docket I am unable to find an arrest warrant, only a warrant in relations to the search and seizure.

FACT FILES: EXPOSING THE LIES, REVEALING THE TRUTH 

Wouter de Swardt and Sergeant Stevens orchestrated a meticulously planned public spectacle of Mr. Russell’s arrest, ensuring maximum media exposure. Simultaneously, SAPS officers unlawfully raided 16 Leirmans Road, removed occupants, and handed over keys to de Swardt without any legal basis or inclusion in arrest warrants.

 

This operation disregarded tenant protections, bypassed legal processes, and exploited public resources, rendering lawful civil litigation efforts futile. Mr. and Mrs. Broad acted swiftly to capitalize on the arrest, preemptively submitting paperwork to solidify their illegal gains while Mr. Russell was incapacitated.

Serg Stevens & Mr De Swardt’s Breach Of Process & Obstruction Of Justice

Chief among the state’s many injustices and errors, the Magistrate and prosecution made a fundamental mistake. The client should have been allowed to leave on the basis of the bail granted, and if the police had any evidence sufficient to lay additional charges, then arrest him on that basis.

 

Instead, the client was recalled, his bail was revoked as if amending a food order, the prosecution’s objection to bail was noted, and the client was sent to Pollsmoor. The client’s attorneys, for reasons explained below, did not show up for this hearing and were therefore not there to pick up on this serious irregularity and breach of process.

 

The arrest, objection to bail, detention, and attempts to prolong imprisonment were motivated by the need to keep the client incarcerated for as long as possible. Serg Stevens was obliging in producing many new and varied reasons for postponing the matter.

 

So much so that the Magistrate, out of frustration, gave the Investigating Officer Serg Stevens an ultimatum: decide what the client is being charged with by the 28th of March. Anything not listed would not be considered.

 

14th December: Arrest at 32 Fisherman’s Bend. The client was removed, and the keys and property were handed over to the owner. At 16 Leirmans Road, a secret and illegal operation arrested and removed the housekeeper, keys were taken, and vacant possession was handed to the owners.

 

15th/16th December: The client was finally allowed to call his attorney, who promised to be at the bail hearing on Monday and sent an attorney the next day to obtain information from the client.

 

19th December: First bail appearance. The client is granted bail set at R2000 and signed off by the magistrate. The prosecution suddenly received communication from Investigating Officer Serg Stevens demanding that they object to bail, giving various reasons: 1) “several new charges to add,” 2) “Issues from Paarl,” and 3) “the accused is an illegal immigrant and a flight risk.” The client’s attorneys fail to show up. The matter is, therefore, pushed to 2023. The client spends three weeks in Pollsmoor over Christmas and New Year’s Eve.

 

6th January: Investigating Officer Serg Stevens says he needs more time for further investigation, despite (in theory) having had a year to do so. It has been almost a month since the arrest. He is not yet ready to confirm the charges and claims money laundering charges are to be added (another lie).

 

2nd February: Investigating Officer Serg Stevens says he needs more time for further investigation. He is not yet ready to confirm the charges and says additional time is required to request bank statements and phone records, despite having had a year to do so and seven weeks since the arrest. This is another lie, and no request was ever made for either. The judge demands he settle the final charges by 28th February. The client’s attorneys fail to attend again.

 

9th February: The client’s attorneys finally confirm their instruction. Surprisingly, they do not push for an immediate hearing on the matter. A date is set to start the urgent bail application, three months after the arrest.

 

28th February: The client’s attorneys heard nothing from Investigating Officer Serg Stevens regarding the final charges. Or rather, they say they did not. Considering their performance, we cannot be sure.

 

13th March: The prosecution withdraws the charges on the morning of and before the bail application starts. The charges are the same as three months earlier; no new evidence exists, no new victims, no new charges. None of the charges referred to objecting to bail or delaying the start of the bail application are ever heard of again.
